Inequine Rewards — Programme Terms

1. What the programme is

Inequine Rewards is a free loyalty programme. You earn points when you buy from us, and you exchange them for money off a later order.

The current earning rate, what points are worth, and the membership levels are published on the programme page at inequine.ch/pages/rewards. That page forms part of these terms.

Points are not money and not a debt we owe you. They have no cash value, cannot be paid out in cash, cannot be bought, sold, given, transferred or inherited, and are not your property. They are a benefit we grant voluntarily under these terms, and which we may adjust or withdraw under clauses 11 and 12.

This is the ordinary basis of every loyalty programme, and it is stated first because the rest of this document depends on it.

2. Joining, and ordering as a guest

There is nothing to join, and you do not need an account to earn. Every order earns points, including one placed without signing in.

When you check out as a guest, a customer record is created from the email address you give at checkout and your points are credited to it. If you later create an Inequine account using that same email address, the points are already there. Nothing to claim, nothing to transfer, no need to contact us.

Two things follow from the email address being what connects them:

  • A different email address is a different person. Points earned under one address do not move to an account opened under another. Write to us if both are genuinely yours and we will combine them.
  • You need an account to spend points. Earning does not require one; redeeming does, because a reward is issued against an account.

3. Eligibility and your account

You must be at least 16. If you are under 18, take part only with the agreement of a parent or guardian — the same person who would agree to the purchase itself.

One membership per person. Points from several accounts held by the same person are not combined except at our discretion, and opening additional accounts to earn more than once is misuse under clause 14.

Keep your account details to yourself. Points redeemed by someone using your sign-in are treated as redeemed by you, unless you tell us promptly that your account has been used without your permission.

4. How points are earned

Points are calculated on the merchandise value of an order — the price of the goods themselves. In particular:

  • Delivery charges do not earn. Shipping is not merchandise, and earning on it would pay you for choosing a faster service.
  • Tax does not earn, where any is charged. (We are not currently VAT-registered, so at present nothing is deducted because nothing is added. If that changes, points will be calculated on the value excluding tax, so that customers in different countries earn the same points for the same goods.)
  • Gift cards do not earn. Buying one earns nothing; the order someone pays for with it earns as normal.
  • Sale prices earn. An item reduced in price earns on the price you pay for it.
  • Some products earn at a different rate, and some earn nothing. Where a product earns nothing, no points figure appears on its page. Where it earns more or less than the standard rate, the figure shown on the product page is what that product earns.
  • Nothing applied to the basket as a whole reduces what you earn. A promotional code, or points you spend on the same order, both leave your points untouched. What a product earns is what its price earns — which is why the figure on the product page is the figure you receive, whatever you end up paying at checkout.

The rate in force when you place the order is the one that applies, and it is the one used if the order is later refunded.

Points are awarded when an order is paid. An order placed but not paid earns nothing.

Points are whole numbers. Where a calculation produces a fraction, it is rounded to the nearest whole point.

5. When points become available

Points are shown as pending until your order has been fulfilled — dispatched, or collected if you chose in-store pickup — and any further holding period shown in your account has passed.

Pending points appear in your account with the date they become available.

The reason for the wait is returns: points are earned on money you have spent, and until the return window closes that money may still come back to you.

6. Spending points

You spend points in your basket, in fixed steps. The size of a step, and what each step is worth, are shown in your basket and on the programme page.

We then issue a discount code for the amount you chose. The code names its own value, so you can see what it is worth at checkout, and we apply it to your basket for you.

The code:

  • is linked to your account and cannot be used by anyone else;
  • can be used once;
  • is valid for a limited period, shown to you when you redeem;
  • can be used alongside other discount codes, where those codes also permit it.

You cannot spend more than the order is worth. A discount larger than the order does not leave a balance for later — the difference would simply be lost — so the amount you can spend is capped at what you are actually paying. Any points above that stay in your account.

Points are deducted when the code is issued, not when it is used.

Changed your mind? Return an unused reward at any time and the points go straight back to your account.

If you do not use a reward before it expires, the points return to your account automatically. You do not lose them, and you do not need to ask — the expiry ends the code, never the points behind it.

7. Membership levels

The programme has levels. A level is reached by spending its threshold, counting merchandise value as in clause 4, and members at a higher level earn points at a higher rate. The levels, their thresholds and their rates are on the programme page.

A level is held for as long as your recent spend covers its threshold. The period we count is published on the programme page, and spend older than that stops counting — so a level can be lost as well as reached.

If your spend falls below a threshold you move to whichever level it does cover. That may be more than one step down, and it happens without you doing anything, because the period moves whether or not you order.

Spend before the programme started does not count towards a level.

If a purchase that took you into a level is later refunded or cancelled, that spend no longer counts and your level is adjusted accordingly. Losing a level does not remove points you have already earned — only the rate at which you earn new ones changes. Points already earned at a higher rate keep their value.

8. Returns, refunds and cancellations

If an order is refunded, the points earned on it are removed in proportion to the amount refunded. If an order is cancelled, all points earned on it are removed.

A refunded or cancelled order also stops counting towards your level, in the same proportion (clause 7).

If you have already spent points that are later removed this way, your balance can go below zero. You will never be asked to pay anything, but you cannot redeem again until it is positive.

A refund does not return points you spent on a reward that was used against that order.

9. Point expiry

Points do not currently expire. They stay in your account until you use them.

If expiry is ever introduced, you will be told in advance under clause 11, and it will apply only from that point forward.

10. Leaving the programme

Write to us and we will close your membership. Unspent points are lost when you do, so redeem them first.

Closing your Inequine account, or asking us to erase your data, also ends your membership and any unspent points.

Stopping programme emails is not leaving the programme. If you turn off emails about your points, you continue to earn and spend exactly as before — only the messages stop.

11. Changes to the programme

We may change the earning rate, what points are worth, the membership levels, and any other term.

Four protections apply to every such change, and none of them is optional:

  1. changes take effect only going forward;
  2. points you have already earned keep the value they had when the change was announced;
  3. anything that reduces that value is announced 30 days in advance; and
  4. you may redeem or leave during those 30 days.

Our records support this rather than merely asserting it: every point movement is recorded permanently with its cause, so what your balance was worth on any past date can be checked.

12. Ending the programme

We may end the programme by giving 60 days' notice, during which you may redeem your remaining points. Points not redeemed by the end of that period lapse.

We will give that notice by email to the address on your account, and publish it on the programme page.

13. If something goes wrong

The programme depends on systems that can be interrupted or delayed. Points may take time to appear after an order, and a balance shown on a page may be out of date. Where a displayed figure and our records disagree, our records govern — every point movement is recorded permanently with its cause, and we correct a display error rather than honour it.

We do not guarantee that the programme is available without interruption. An interruption does not remove points you have already earned: crediting is deferred until the system recovers, not cancelled.

Where a technical fault credits points that were not earned, or shows a balance that is wrong, we may correct it. We will tell you when we do, and the reason is recorded.

We are not liable for indirect or consequential loss arising from the programme.

Nothing in these terms limits liability that cannot lawfully be limited. In particular, we do not exclude liability for intentional acts or gross negligence, for death or personal injury, or for fraud.

Your statutory rights as a consumer in relation to the goods you buy are unaffected by these terms.

14. Misuse

We may remove points, cancel rewards and close a membership where points have been obtained through misuse. That includes placing and refunding orders in order to generate points, opening more than one account to earn more than once, using another person's account, and exploiting an error in the programme.

Where points are removed, the reason is recorded and available to you on request.

Conduct of this kind may also be unlawful. Where it is, we may pursue the remedies available to us under Swiss law, including recovery of our losses, in addition to the steps above.

15. Your data

Membership requires us to store your customer identifier, your first name and email address, your points balance, and the history of how it changed — including the orders that earned points and the rewards you redeemed.

Your name and email address are used to send you the emails described above and for nothing else.

You may request a copy of this data, or its erasure, through the usual channels. Erasure removes the link between that history and you; the anonymised financial record is retained. This is governed by our privacy policy and by the Swiss Federal Act on Data Protection and, where it applies, the GDPR.

16. General

If any part of these terms is found to be unenforceable, the rest continues to apply, and the unenforceable part is replaced by the lawful provision closest to what it was meant to achieve.

We may transfer our rights and obligations under the programme to another business; your points and level go with them. You may not transfer yours.

These terms, together with the programme page, are the whole agreement about the programme.

17. Governing law

These terms are governed by Swiss law, and the courts of our registered seat in Switzerland have jurisdiction.

This does not take away any protection you have where you live. If you are a consumer resident outside Switzerland, you keep the mandatory protections of your own country's law, and you may bring proceedings in the courts of your own country. We will bring any claim against you in the courts where you live.
